Hi Nicky - I do believe these are only enforceable within the USA. I agree, there is definitely imbalance but I guess that comes with the territory and applies to many things!

I have no problem with these rules but as I blog from Ireland I'm assuming these laws are not enforcable outside the USA? Perhaps you can clarify this point. There are many, many fashion bloggers around the world does and if these laws don't apply isn't there imbalance across the world?

I really enjoyed reading this and I thought all the answers were reasonable and made sense. As a blogger, my one contention against this FTC ruling is we aren't held to the same standard as journalists and magazines. Magazine writers get invited to free spa days, hotel stays, and yes, clothes too and aren't required to disclose whether they received this complimentary or not (in each specific article); there might be a general disclaimer from the mag as a whole, but there isn't an indicator in each article outlining what was complimentary and what was not...

The affiliate marketing issue is probably the most difficult one. It's not your affiliate ads --it's the deep links within posts. I'm recommending two things:
1. List your affiliates by name in your broad disclosure policy. Something like "This blog participates in affiliate marketing programs through which we may receive a small commission for sales referred directly to the seller. Links in posts may include our affiliate codes. Currently these are our affiliates: and then list them.
2. When using an affiliate link in post, note it. "You can buy x at my affilate y" or (affiliate link) after the link etc.

Hopefully, the broad disclosure will be sufficient in the long run, but for now I'd probably do both.
